TCG BOOSTER POD – HOST LOCATION TERMS

Effective Date: June 4, 2026

1. Independent Business Relationship

The relationship between TCG Booster Pod and Host Location is strictly that of independent business entities.

Nothing in this Agreement shall be construed as creating:

  • Partnership
  • Joint venture
  • Franchise
  • Agency relationship
  • Employment relationship

2. Machine Ownership

All vending machines remain the sole property of TCG Booster Pod unless otherwise agreed in writing.

The Host acquires no ownership interest in the machine.

3. Placement Rights

Host grants TCG Booster Pod permission to place and operate vending equipment at the approved location.

4. Access Rights

Host shall provide reasonable access for:

  • Maintenance
  • Repairs
  • Inventory replenishment
  • Equipment upgrades

5. Utilities

Host agrees to provide standard electrical power necessary for machine operation.

6. Revenue Sharing

Compensation shall be governed by the separate Location Agreement.

Revenue sharing percentages, rent payments, or commissions must be documented separately.

7. Product Selection

TCG Booster Pod maintains sole discretion regarding:

  • Product inventory
  • Product pricing
  • Promotions
  • Product availability

8. Security and Protection

Host agrees to exercise reasonable care to protect the machine from:

  • Theft
  • Vandalism
  • Intentional damage

Host shall not be liable for criminal acts by third parties unless caused by Host negligence.

9. Trademark Disclaimer

TCG Booster Pod is an independent reseller.

The Host acknowledges that TCG Booster Pod is not affiliated with, endorsed by, sponsored by, licensed by, or partnered with any manufacturer, publisher, game company, entertainment company, sports league, athlete, celebrity, or trademark owner unless expressly stated in writing.

All trademarks remain property of their respective owners.

10. Insurance

TCG Booster Pod shall maintain commercially reasonable insurance coverage for its operations.

11. Term and Termination

Either party may terminate the relationship upon 30 days written notice.

Immediate termination may occur for:

  • Illegal activity
  • Property damage
  • Breach of contract
  • Safety concerns

12. Limitation of Liability

Neither party shall be liable for indirect, consequential, or incidental damages.

13. Governing Law

This Agreement shall be governed by the laws of the State of New Jersey.

14. Entire Agreement 

These terms, together with the Location Agreement, constitute the entire agreement between the parties.
